Joe Gonyea has a substantial national appellate practice in the federal courts of appeals, and in the state appellate courts. With his broad experience in appellate matters, he has taken on some of the most complex legal issues, including securities fraud, money laundering, and all forms of constitutional violations. He has argued cases before the Fifth Circuit Court of Appeals in New Orleans, the Fourth Circuit Court of Appeals in Richmond, Virginia, the Texas Court of Criminal Appeals in Austin, and in many lower state courts of appeals.

Joe Gonyea has obtained appellate relief for numerous clients on a variety of legal issues, including the following:

The United States Court of Appeals for the 4th Circuit in Richmond, Virginia reversed the money laundering convictions of a former businessman who was sentenced to 60 years in prison for a $100 million life insurance fraud scheme. The court ruled that the funds the government alleged were laundered were essential expenses of the underlying fraud, not a separate act intended to conceal the origin of the funds or to perpetrate another fraud.

Joe Gonyea obtained a significant decision from the Texas Court of Criminal Appeals in a case of first impression. Police obtained a search warrant from a county court at law judge in Montgomery County. They executed the search warrant in Harris County. The trial court denied the defendant’s motion to suppress the evidence. The Court of Criminal Appeals heard argument, overturned that decision, and held that the jurisdiction of a statutory county court at law judge to issue a search warrant is limited to the county of the court.
